A hearing in which a judge would consider throwing out a charge against Chris Soules has been delayed.

The state requested more time to prepare for the hearing. A new date will be scheduled on October 16 via a teleconference.

The 35-year-old former "Bachelor" star is accused of leaving the scene of a fatal accident after driving his truck into a tractor on April 24. 66-year-old Kenneth Mosher died as a result after his tractor rolled into a ditch. His defense wants the charge thrown out because they say he did everything required of him by calling 911 and staying on the scene until they arrived.

He has pleaded not guilty.
