Ellingson Drowning Goes to Jury

KANSAS CITY, MO (CBS2/FOX28) - Jurors will now decide whether a Kansas City officer was negligent when an Iowa man drowned on his watch.
Back in May, 20-year-old Brandon Ellingson was boating on Lake of the Ozarks when Officer Anthony Piercy stopped him.
Authorities say officer Piercy thought Ellingson was boating while drunk so he tried to arrest him.
While Ellingson was in handcuffs he stood up and fell or jumped overboard and his life vest came off.
Ellingson went under the water and didn’t re-surface. The next day, crews found his body.
His family says, the officer didn't put the life jacket on properly and believe that cost Ellingson his life.
A court proceeding is set for September fourth.
