Legal Win For Head Shop Owners
IOWA CITY, IA (CBS2/FOX28) - The Iowa Court of Appeals has given a legal victory to the owners of head shops.
The court ruled that unused pipes are not drug paraphernalia and under Iowa law, cannot be confiscated by law enforcement.
That means, officers will have to return pipes they took from stores like Day Dreams in Des Moines when they were serving warrants.
Under state law, if the pipes were considered drug paraphernalia, selling them would have been a felony.
