13 Year Old Charged With Assault

DUBUQUE (CBS 2/FOX 28) - A 13 year old student has been charged with assaulting two other students on a Dubuque Community School District Bus.

Dubuque Police and the District received a complaint Tuesday about the alleged assault which happened Monday morning.

Authorities say the incident involved the 13 year old student firing an airsoft gun at least twice, striking two students on a bus carrying Roosevelt Middle School and Hempstead High School Students.

In a letter sent to parents today, the district says the gun was also in the student's backpack during the school day at Roosevelt.

One student was uninjured, the other received a minor injuiry that did not require medical care.

Police tell CBS 2/FOX 28 News Asbury police are investigating a similar, but separate incident that happened Monday afternoon that also involved a 13 year old.

The student has not been identfied, but police say charges of one count of Assault Causing Injury and one count of Simple Assault will be brought against the child in juvenile court.

Both the police and district also reminded students, parents and guardians that airsoft guns, as with any weapon, are prohibited on school property.

In its letter, School Superintendent Stan Rheingans says this is the second such incident in the barely started school year and "the seemingly growing presence of these weapons is concerning."

While we believe," says Rheingans, "that many students simple see these weapons as toys (they are non-lethal and not considered a firearm), it is important for you to know that both the school district and area law enforcement do not take the presence of these weapons lightly."
